KANIYONIKA Terms of Service

Effective date: October 2, 2026.

1. Operator and scope

KANIYONIKA is the trade name of a sole proprietor operating in Japan. In these Terms, “we,” “us,” and “our” refer to that proprietor. These Terms cover the apps, games, websites, and Lumopi-branded services we provide (the “Services”).

These Terms form part of an agreement with us where you accept them or we indicate, before you enter the agreement, that they apply. Prices, purchased features, supported environments, and other product conditions shown before purchase or use also apply to the relevant product.

Apps obtained through an app store are also subject to that store’s applicable purchase, use, and license terms, including Apple’s Standard End User License Agreement and the Google Play Terms of Service, where applicable. These Terms supplement those store conditions and do not replace the applicable license agreement or override mandatory store rules.

2. Using the Services

We do not set a single minimum age for all Services. Please follow any age restrictions stated for the relevant service, the store’s conditions, and applicable law. If you are a minor, obtain a parent’s or legal guardian’s consent for contracts and purchases where the law requires it.

Use the Services within their intended functions and the applicable product and license conditions. You are responsible for your device, internet connection, and any communication charges. Do not use another person’s payment method or store account without authorization.

3. Intellectual property and prohibited conduct

Rights in the Services and their software, images, audio, and other content belong to us or the respective rights holders. Permission to use a service does not transfer ownership of those rights.

You must not:

Gameplay videos, streams and screenshots

For the games we provide, and for content in which we hold the rights, you may publish videos, live streams and screenshots of your own gameplay. This includes monetization through the standard features of video and streaming platforms. We appreciate a mention of the game name or a link to our website when you share.

This permission does not cover implying an official partnership or broadcast, or extracting images or audio from the games to redistribute or sell as standalone assets. Use third-party assets only as permitted by their licenses. If you are unsure about the conditions, please contact us using the address in Section 8.

4. Paid apps and in-app purchases

Prices, the features or content being purchased, supported environments, and any conditions of use are those shown in the store or purchase screen before purchase. Payments for paid apps and in-app purchases currently take place through app stores. Payment, cancellation, and refund procedures follow applicable law and the relevant store’s rules. Use the store’s procedures for store-managed transactions, and contact us about issues with features or content we provide. We do not offer an additional unconditional refund guarantee.

You may use purchased features and content under the conditions shown at purchase. A one-time purchase does not by itself promise new features, compatibility with every future operating system or device, or indefinite availability of online functions. This does not reduce what was expressly included in your purchase or any supply or update obligations required by law.

Deleting app data, reinstalling an app, or changing devices may affect locally stored progress and settings. Whether a purchase can be restored depends on the product type, store account, purchase records, and applicable store rules.

5. Advertising, external services, and privacy

Some Services display advertising or include external services and links. Third-party offers, purchases, and use of external services are subject to the respective provider’s conditions. We do not guarantee those providers’ content or offers; this does not exclude responsibility that the law places on us.

Our Privacy Policy explains how information is handled and how to make privacy choices and requests. Accepting these Terms does not replace any separate consent required for advertising, analytics, or other processing.

6. Changes, interruptions, and restrictions

We may update, change, temporarily interrupt, or discontinue a service for maintenance, faults, security, legal requirements, changes in the operating environment, or other business reasons. We do so in accordance with the agreement and applicable law. Taking account of the effect on purchased features, we provide notices, remedies, or refunds where required by law, the purchase conditions, or applicable store rules.

We may restrict access or remove content to the extent reasonably necessary to address violations of these Terms, fraud, security risks, or legal requirements. Emergency action may be taken before notice where permitted by law. Restrictions do not remove any rights to refunds or other remedies that cannot legally be excluded.

7. Warranties and liability

Except for what we expressly promise for a product or what the law requires, we do not guarantee uninterrupted or error-free operation, compatibility with every environment, or suitability for every purpose. We do not promise indefinite support, updates, or preservation of records. These statements do not remove obligations arising from your purchase or mandatory law.

Where we are liable for damages caused by our ordinary negligence, our liability is limited to direct loss ordinarily arising from the relevant breach of contract or wrongful act.

The reference amount is the total fees and purchase prices you paid for the Service that caused the loss during the one month preceding the event that caused it. Where the reference amount is greater than zero, our aggregate liability to you for losses arising from the same cause or a series of related causes is capped at that amount, regardless of the number of claims.

Where the reference amount is zero, we are not liable for damages caused by ordinary negligence. This exclusion does not apply where Article 8 of Japan’s Consumer Contract Act or other applicable law prohibits excluding liability entirely. We do not offer a separate minimum compensation amount.

These limitations on the scope and amount of damages and the exclusion of liability apply only to ordinary negligence. They do not apply to intentional misconduct or gross negligence by us or persons for whom we are legally responsible, or any other liability that cannot be limited under applicable law. For death or personal injury, these provisions do not apply to the extent that applicable law prohibits them.

Nothing in these Terms excludes mandatory consumer protections, including applicable rights to cancellation, refunds, repair, or other remedies.

8. Changes to these Terms, applicable law, and contact

We may change these Terms where the change benefits users generally or does not conflict with the agreement’s purpose and is reasonable in light of the need for the change, the appropriateness of the updated terms, and the circumstances. We announce the change, the updated Terms, and their effective date on our website or by another appropriate method. Where required by law, we complete this announcement before the changes take effect, provide any required notices, and obtain any required agreement.

Japanese law governs these Terms. This choice does not deprive you of mandatory consumer protections that apply under the law of your country of residence. Jurisdiction over disputes follows applicable law. If a provision is invalid, the remaining provisions continue to apply to the extent permitted by law.
